The
following Standard Terms and Conditions (“STC”) set out the basis upon which you
(“the Customer”) can visit, and make purchases from, the website of Polka Dot
Clothes (“Polka Dot”).
Availability
All products
are subject to availability. If the Customer’s order cannot be fulfilled then
they will be notified as soon as possible by email.
Placing
an order and Polka Dot’s acceptance of it
Acceptance
of the Customer’s order by Polka Dot takes place only upon despatch of the
Customer’s goods.
Prices
All prices
stated are in Pounds Sterling (£). Polka Dot only accepts payment in Pounds
Sterling (£).
Payment
Payment for
purchases can be made by cash (sent at Customer’s risk), cheque or Paypal. No
goods will be dispatched prior to full payment being received by Polka Dot. In
the case of payment by cheque, goods will not be dispatched until the Customer’s
cheque has cleared – this usually takes 4 – 5 working days. Polka Dot ships
goods as soon as possible after full cleared payment has been received.
Delivery
The delivery
charge is stated on Polka Dot’s website next to each item. Please note that this
delivery charge is for second class standard postage for that item within the
United Kingdom only. Polka Dot is happy to ship goods world-wide – please email
Polka Dot for a delivery charge. In the event of a Customer making multiple
purchases from Polka Dot then a postage discount will be applied – please email
Polka Dot for details having decided on your purchases and the cost will be
advised.
Returns
Any goods
returned by the Customer to Polka Dot must comply in all respects with Polka
Dot’s returns terms set out herein. If the Customer needs to return an item then
please email Polka Dot immediately to advise it of this fact. Items must be
returned to Polka Dot within seven days of their being received by the Customer.
Only goods which are unused, unworn and undamaged may be returned to Polka Dot.
If an item was tagged or labelled then such tags or labels must still be intact
and attached to the goods. Polka Dot cannot refund for items that are returned
to it smelling of smoke. All items must be securely packed and correctly
addressed for their return to Polka Dot - and the postage paid for by the
customer. Should the items be lost in the post Polka Dot cannot accept liability
for this; it is the customer’s responsibility to ensure the good’s safe return.
If the Customer is within the European Union and places an order via this
website the Customer has the legal right to cancel its order within seven
working days of receipt of the goods, and subject to the terms of Polka Dot’s
return’s policy. Polka Dot cannot accept returns that are outside the scope of
this provision. Polka Dot can only accept returns from Customers within the
European Union. Provided that the returned goods are received by Polka Dot in
full compliance with this provision then a refund – minus the delivery charge –
will be issued to the Customer. If the Customer wishes to exchange an item then
a further delivery charge will be imposed.

makes every effort to ensure that the information shown on its website is
accurate and up to date. In particular, Polka Dot takes all reasonable care in
ensuring that the prices displayed on its website are correct, and that all
products are fairly described. Orders are only accepted by Polka Dot if there
are no material errors in the price and/or description stated on the website.
Privacy
Polka Dot
will not make the Customer’s personal details available to any third parties and
will only use such data so that the Customer’s order can be processed.
Exclusions of Liability
All
exclusions of liability herein shall be governed by, and construed in accordance
with, English Law. If any provisions of such exclusions of liability shall be
held to be unlawful, void or unenforceable then that provision shall be deemed
severable and shall not affect the validity and enforceability of the remaining
provisions.
Changes
to STC
Polka Dot
reserves the right (without notice) to update these STC from time to time.
Ownership
of Rights
All rights,
including copyright, in this website are owned by Polka Dot. Any use (which
includes copying or storing) of this website, or any part of it, other than for
a Customer’s own personal non-commercial use is prohibited without the prior
written consent of Polka Dot. In addition it is strictly prohibited to link to
this website without the prior written consent of Polka Dot.
Applicable Law and Jurisdiction
This
website, its content and any contract or transaction resulting from it are
governed by, and to be construed in accordance with, English Law. The parties to
any such contract agree to submit to the exclusive jurisdiction of the courts of
England.
